At Levante Properties, our aim is to make our terms and conditions are as clear and straightforward as possible. If you have any questions or wish to discuss anything, please don’t hesitate to ask, we are always here to help:
1) Levante Properties (Levante Properties Real Estate SL) charges a discounted and unique sales commission of 4 percent plus IVA (Spanish VAT charged at 21 percent) for exclusive listings, with a minimum commission of €4.950 plus IVA. If you decide to instruct any other agent, Levante Properties will charge a commission of 5 percent plus IVA, with a minimum commission of €5.950 plus IVA.
2) The agency commission will be calculated according to the eventual selling price agreed. The applicable commission rate becomes payable on the signing of the reservation/deposit agreement formalising the sale, with payment typically deferred to completion.
3) For properties listed with Levante Properties, the agreement covers an exclusive period of 24 weeks. We will register and introduce the potential buyer to you. If at any point a sale is agreed with a buyer introduced by Levante Properties, or with whom Levante Properties had negotiations about the property, our commission will be payable.
4) Depending on resort’s regulations, Levante Properties will usually install a For Sale sign at the property. We understand that some owners will prefer to not have a For Sale board, if this is the case, please let us know.
5) When a sale is agreed, a 10 percent non refundable deposit will typically be paid, usually in two separate instalments, by the purchaser. Should the purchaser withdraw from the sale, Levante Properties will retain the first 5.000€ of the deposit for expenses incurred, with any remaining balance paid to the vendor.
6) Should a vendor withdraw from a sale once the signing of the reservation/deposit agreement has occurred, in addition to the penalties stated on the agreement under the Spanish Civil Code, Levante Properties’s commission will be payable.
7) During the sales process, Levante Properties may offer purchasers and vendors financial, mortgage and legal advice, via third parties, including banks and currency exchange companies with the aim of ensuring that both buyer and seller receive the best possible service. In some cases, Levante Properties may earn a commission from these referrals.
8) Levante Properties cannot accept responsibility for the maintenance or repairs of unoccupied properties for sale unless also appointed to manage the property.
9) If there is any breach of these terms of business by the vendor, the property will be withdrawn from sale and the vendor will be charged for administration expenses of €500.00 + IVA fee.
